United States Certificate of Insurance Notice: Montreal Convention Liability Limits
2019 Revised Limits of Liability Under the Montreal Convention of 1999
The International Civil Aviation Organisation (ICAO) has proposed a 13.9% increase to the Montreal Convention’s liability limits following completion of its latest review. The increase is based on the accumulated rate of inflation (weighted by reference to the average Consumer Price Indices of the United States, Japan, China, European Union and the United Kingdom) since 2008, when the last adjustment was made.
The revised liability limits will take effect from December 28, 2019 and are shown below:
- 1,288 SDR per passenger for damage to baggage and delayed carriage of baggage
- 5,346 SDR per passenger for damage caused by delay
- 22 SDR per kilogram for damage to cargo
Accordingly, in late October, Global Aerospace, Inc. updated our applicable certificate of insurance templates for US Policyholders which have a reference to these limits. Certificates issued after this update evidence the new limits and are compliant.
We are in the process of reissuing certificates of insurance issued prior to this update to reflect the new limits. These updated certificates will be distributed via email to brokers in the United States the week of December 16.
